What is POPI?

In simple terms, the purpose of the POPI Act is to ensure that all South African institutions conduct themselves in a responsible manner when collecting, processing, storing and sharing another entity’s personal information by holding them accountable should they abuse or compromise any personal information.

By when do you need to comply?

The deadline for compliance with the Act is 01 July 2021. This means that there is less than two left to ensure compliance with the Act.

Who does it apply to?

The POPI Act applies to every person and business in South Africa that collects and processes personal information, no matter how big or small.

What is personal information?

Personal information is essentially any information that identifies a person. Personal Information is defined as “information relating to an identifiable, living, natural person, and where it is applicable, an identifiable, existing juristic person”

How do you comply?

It is advisable to conduct an audit on the flow of personal information within your business, including the measures in place to store and protect such information. This includes information from customers and prospective customers via a website, employee information, information collected when entering an estate, information from suppliers, etc.

An information officer will need to be appointed for your business. The purpose of an information officer is to ensure compliance with the POPI Act. Information Officers will need to be registered with the Information Regulator via their online portal or by completing the form found on their website.

What do I need to do if I have a website that collects personal information?

You should have a website privacy and cookie policy which highlights the privacy you have in place when processing a persons personal information.
